Partner visa

 

There are a range of partner visas available depending on your circumstances.

 

Spouse temporary visa (subclass 820) and permanent visa (subclass 801)

For people to stay in Australia with their Australian partner. If two years after you apply the spousal relationship is ongoing, a permanent visa may be granted.

 

Interdependency temporary visa (subclass 826) and permanent visa (subclass 814)

For people to stay in Australia with their Australian partner. This visa is generally for people in a same sex relationship.

 

Spouse Temporary Visa (Subclass 309) and Permanent Visa (Subclass 100)

For people from overseas to enter and stay in Australia with their partner.

 

Prospective Marriage Visa (Subclass 300)

For people from overseas to enter Australia, then marry their fiance(e). Once married, holders of this visa can then apply to remain permanently in Australia.

 

Interdependency Temporary Visa (Subclass 310) and Permanent Visa (Subclass 110)

For people from overseas to enter and stay in Australia with their partner. This visa is generally for people in a same sex relationship.

 

What evidence is considered?

 

It is important that a couple claiming a de facto or interdependent relationship is able to provide evidence that their relationship is consistent with a 'spouse-like' relationship.

 

Some of the factors to be considered in deciding whether the partners satisfy the requirement include:

  • knowledge of each other's personal circumstances
  • financial aspects of the relationship,
  • joint financial commitments such as real estate or other assets and sharing day-to-day household expenses
  • the nature of the household, including living arrangements and joint care and
  • responsibility for any children of the relationship
  • the social aspects of the relationship, provided in statements (statutory declarations) by friends and acquaintances and
  • the nature of the commitment, including duration of the relationship, how long the couple has been living together and whether they see the relationship as a long-term one
